Introduction
The Living Sector is facing arguably the most transformative legislative landscape in over 35 years with the Renters' Right Act receiving Royal Assent on 27 October 2025.
At Charles Russell Speechlys the developments surrounding this have been at the core of our work. The winter edition of our Living Sector newsletter therefore brings together the changes we anticipate in light of this Act as well as additional thought leadership from our Real Estate, Real Estate Disputes, and Construction and Engineering teams. In this second edition, we touch in with the progress and likely consequences of the Renters’ Rights Act, examining what this means in practice for student accommodation providers and build to rent investors. We set out the challenges that this Act may bring, including the changes to provisions on assured tenancies. We also provide insight into the traps that landlords should avoid falling into which may prevent them from recovering possession. We also dive into the theme of safety as an ongoing concern for developers, discussing new regulations arising from the Building Safety Act 2022 (BSA) but also the Government’s proposals to overcome the delays to high-risk projects that have resulted. The Construction, Engineering & Projects team also discuss fresh case law which outlines the circumstances in which remediation contribution orders may be made in relation to fire-safety defects. Along with a spotlight on tax for developers and the very topical Biodiversity Net Gain rules, we look over the sector as a whole and consider what trends are impacting investment decisions in the Living Sector. Finally, as we head towards a new year, we look back on 2025 in the Capitalise Purpose Built Student Accommodation market as well as the Living Sector more generally, providing insight as to where opportunities for investment can be found. We hope this edition provides a practical insight for those seeking to navigate these ongoing developments. Should you wish to discuss any of these topics further, please do not hesitate to reach out.
