We have updated the publication to make it more interactive. We hope that you enjoy the new layout and welcome any feedback you may have.

In this edition of Infra.Law you will find articles on a range of issues which affect our industry. Over the summer, the Supreme Court handed down its judgment in the case of Triple Point Technology, Inc v PTT Public Company Ltd, which was followed by Eco World - Ballymore Embassy Gardens Co Ltd v Dobler UK Ltd, concerning the interpretation of liquidated damage clause wording. These cases are considered by my colleague Andrew Keeley. The summer also saw the Government publish the draft Building and Safety Bill which will have far reaching implications for the design, construction, management and occupation of buildings over 18 metres with two or more residential units. My colleague Carolyn Davies discusses the implications and requirements for developers and owners of such buildings to produce and maintain the “Golden Thread” of information.

The Government also published a call for evidence seeking evidence as to the best way to resolve disputes without resorting to litigation. Max Davis considers whether this will ultimately lead to compulsory ADR for parties in dispute.

Elsewhere, my colleagues Antony Vundi, Nia John, Gabrielle Shovlin discuss a number of cases concerning the right to adjudicate under a Collateral Warranty, the drafting of standard terms and conditions and the drafting of witness statements and legal privilege, whilst Helen Coward considers the implications of the Finance Bill for asset holding companies in the UK.

Finally, Eddie Richards hosts a podcast to discuss the challenges facing operators and investors in Logistics and bid sheds. Eddie is joined by Kevin Mofid, head of logistics and industrial research at Savills and Kim Farley, a principal in the UK investment and leasing team at EQT Exeter.
